General Terms of Use and Sale

2. Acceptance of terms

You accept these Terms by checking the designated box before saving your program. Simply browsing public pages does not constitute acceptance. If you do not accept these Terms, you cannot create an account or use the authenticated service.

We may update these Terms to reflect legal, technical, or service developments. A material change will be announced before it takes effect via email or within the application. When a new acceptance is legally required, it will be explicitly requested; continued use does not replace it.

3. Saving your program

To save your program, you use a valid email address with a one-time code or, when these options are offered, your Google, Apple, or Microsoft account. These providers serve solely to authenticate you and to create or link your WorkoutGen account.

WorkoutGen is restricted to individuals aged 18 or older. You must confirm you are of legal age before saving a program or subscribing to WorkoutGen Max. An account identified as belonging to a minor will be blocked and then deleted according to our erasure procedure.

You agree to provide accurate information and to keep it up to date. The account is personal and must not be shared.

By saving your program, you agree that WorkoutGen may send you emails necessary for the operation of your account and the service, including security, login, billing, subscription, legal information, and service continuity messages. Optional communications, such as setup or product usage tips, can be disabled from Settings or via the unsubscribe link in those emails.

We reserve the right to refuse or block the creation of an account, notably in the case of a disposable, falsified email address or one previously associated with fraudulent use of the service, without having to detail the reason.

4. Plans and pricing

4.1 Free version

WorkoutGen offers a free version including:

• Personalized training programs by the deterministic engine, validated by Jeremy Tellier, state-certified coach, on the athletic methodology level
• Exercise library with video demonstrations
• Workout tracker to log sets, reps, weights, durations, personal records, and weight measurements
• Web access from any modern browser, installable as a Progressive Web App on iOS, Android, and desktop
• Offline continuation of an already loaded workout, with delayed synchronization once connection is restored
• Ad-free in the current offering

4.2 Premium subscription (WorkoutGen Max)

WorkoutGen Max unlocks advanced features:

• Weight suggestions based on logged performance
• Advanced dashboards and program/workout editing features
• Deterministic analysis of performance trends, including plateaus and oscillations
• The free program and tracker remain included after subscribing to Max.

4.3 Pricing

Applicable pricing:

• WorkoutGen can be used for free with its essential workout features.
• The WorkoutGen Max price is displayed at checkout and on the subscription screen.

WorkoutGen selects a regional pricing tier based on your geographical area. The Lemon Squeezy checkout displays the final price, frequency, currency, and applicable taxes before payment, and then processes the transaction as Merchant of Record.

4.4 Subscription activation

When you subscribe to WorkoutGen Max, your subscription activates immediately and you are billed. You can cancel at any time from your account settings. The cancellation takes effect at the end of your current billing period.

4.5 Subscription changes

You can switch from monthly to annual billing at any time from Settings → Subscription. Cancellation takes effect at the end of the current billing period. Your workout data is preserved when you downgrade to the free version.

4.6 Results and projections

Results estimations displayed by WorkoutGen (including 30-day or one-year projections) are provided for illustrative purposes. They assume full adherence to the program (no missed workouts, intensity in line with recommendations), proper nutrition, and quality sleep. These are potential initial results, not final results. They vary from person to person based on starting point, health, and consistency, and do not constitute a promise or guarantee of results.

5. Payment and Billing

Payments are processed by Lemon Squeezy, a service operated by Sold through Link, LLC, as Merchant of Record. Payment methods offered at checkout may include credit cards, PayPal, and other local methods depending on the country.

We never store your credit card information on our servers. All transactions are encrypted and secured in accordance with PCI-DSS standards.

Subscriptions automatically renew at the end of each billing period unless you cancel. You can cancel your subscription at any time from your account settings.

Invoices for all your payments are available at any time via the Lemon Squeezy customer portal, accessible from your account settings.

As Merchant of Record, Lemon Squeezy, a service operated by Sold through Link, LLC, is the merchant of payment and handles the transaction, taxes, and billing inquiries. By making a purchase, you also accept the Lemon Squeezy Terms of Sale.

Before paying, the checkout displays the chosen plan, its frequency, its automatic renewal, the total price, the currency, and applicable taxes. You can review and correct the displayed information before confirming an order with an obligation to pay.

After payment validation, a confirmation and a receipt are sent on a durable medium to the email address provided. The contract is concluded when the payment is accepted and the confirmation is issued.

Purchases via the iOS App

If you subscribe from the iOS app, the purchase is processed by Apple via the In-App Purchase system. Apple, and not Lemon Squeezy, is then the seller of the payment (Merchant of Record) for this subscription.

Renewal is automatic unless canceled at least 24 hours before the end of the current period, managed exclusively from your Apple account settings (Settings → [your name] → Subscriptions), never from WorkoutGen.

Refunds for iOS in-app purchases are exclusively handled by Apple, according to its own terms, accessible from reportaproblem.apple.com or your Apple account settings. WorkoutGen can neither initiate nor guarantee a refund for this channel.

6. Cancellation and Refunds

You can cancel your subscription at any time. The cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partially used periods, without prejudice to mandatory legal rights (including the applicable right of withdrawal).

If you are a consumer in the European Union, you generally have a 14-day right of withdrawal for a distance purchase, unless a legal exception is validly implemented. If you expressly request that the service begin immediately and then withdraw before the end of the period, a proportional amount for the service already provided may remain due where provided by law. A loss of this right only occurs if all corresponding legal conditions are met and presented at checkout; these Terms do not create any general waiver.

7. Use of the Service

7.1 Acceptable Use

WorkoutGen is intended for personal use only. You agree to:

• Use the service in accordance with applicable laws
• Do not share your account with others
• Do not copy, reproduce, or distribute the app's content without authorization
• Do not attempt to bypass security measures or access unauthorized features
• Do not scrape or automatically extract generated programs, exercise data, or metadata beyond normal personal use
• Do not use the service or its outputs to reconstruct the generation system, create a competing service, or build a training, evaluation, or benchmarking dataset
• Do not use protected content to train an AI or perform text and data mining without authorization, to the extent that these rights are reserved, unless otherwise provided by mandatory law

7.2 Exercise Disclaimer

WorkoutGen generates recreational fitness programs. If in doubt about a workout or an exercise, seek advice from a qualified professional before continuing.

• Users are responsible for knowing their own limits
• Start gradually and progress at your own pace
• Adjust intensity according to your comfort level
• Use proper form for all exercises

You remain responsible for adapting the workout to your abilities and environment. Stop the workout in case of pain, discomfort, or unusual symptoms and seek, if necessary, the advice of a qualified professional.

8. Intellectual Property

The original source code, texts, audiovisual works, interface design, as well as the protectable selection, organization, and arrangement of WorkoutGen content are subject to rights held by their respective owners or licensed by JCODE, and are protected under applicable law. Ideas, methods, features, and algorithms are claimed only to the extent protected by law.

A limited, non-exclusive, and non-transferable license is granted to you to access the app and use your generated program for your personal training. Any commercial reuse, publication, reproduction, or modification requires prior written authorization, subject to mandatory legal rights.

The name "WorkoutGen" and its logo are distinctive signs used by JCODE. No registered trademark status is claimed here.

JCODE expressly reserves, within the limits permitted by law, the rights to the protected selection and arrangement of its databases as well as text and data mining rights. Mandatory legal exceptions remain applicable.

Apart from their normal viewing within the Service and mandatory legal exceptions, photographs, images, and videos produced or filmed for WorkoutGen, as well as their still images, clips, soundtracks, thumbnails, and sequences, may not be extracted, copied, recorded, republished, embedded, cropped, edited, modified, synchronized, broadcast, resold, used in an advertisement, product, or service, incorporated into a dataset, or used to train, evaluate, or feed an artificial intelligence system without the prior written authorization of the rights holder or JCODE when authorized to grant it.

10. Digital Guarantee and Liability

JCODE uses reasonable means to keep WorkoutGen accessible and compliant with its description. However, interruptions due to maintenance, network issues, or service providers may occur. Legal guarantees applicable to digital content and services remain fully applicable.

JCODE is liable for direct and foreseeable damages caused by a breach attributable to it. JCODE is not liable for damage caused exclusively by improper use of the service, user equipment, or an external event beyond its reasonable control.

No clause in these Terms excludes or limits liability that cannot be legally excluded or limited, notably in cases of willful misconduct, gross negligence, personal injury attributable to JCODE, or the application of a legal guarantee. Any other limitation applies only to the extent permitted by law.

For a lack of conformity of WorkoutGen Max, the consumer benefits from the legal warranty throughout the duration of continuous supply. They may request conformity at no cost. In cases provided for by law, notably in the event of refusal, impossibility, unjustified delay, or major inconvenience, they may obtain a price reduction or the termination of the contract. Write to contact@workoutgen.app; JCODE coordinates the request with Lemon Squeezy, the payment merchant, without depriving you of direct recourse against them.

11. Termination

You can delete your account at any time from the application settings. Deletion is permanent and erases service data, subject to invoices and other information we are legally required to retain.

We reserve the right to suspend or delete your account in the event of:

• Violation of these Terms
• Fraudulent use of the service
• Abusive behavior toward our team or other users
• Non-payment of amounts due

In the event of termination for serious breach, no refund is in principle provided, without prejudice to mandatory legal rights.

12. Modifications to the Service

We may evolve, suspend, or discontinue a feature for technical, legal, or security reasons. Any substantial modification to a paid service will be announced on a durable medium within the required timeframe and does not reduce legal rights to termination, compliance, or refund.

Prices offered for new purchases may change. If a change is to affect the renewal of an existing subscription, it will be notified in advance and will only apply according to the legally applicable process and conditions; you can cancel before renewal.

13. Applicable Law and Jurisdiction

These Terms are governed by French law. Mandatory consumer protection rules of your country of residence remain applicable when legally required.

Any dispute relating to these Terms must first be addressed to our support for an amicable resolution. Failing an amicable solution, the dispute may be brought before the competent courts according to applicable law, including mandatory rules of consumer jurisdiction.

In accordance with Article L.612-1 of the French Consumer Code, you may also submit any dispute to a consumer mediator free of charge.
