2. Acceptance of Terms

By creating an account or using WorkoutGen, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

We may update these Terms to reflect legal, technical, or product changes. For material changes, we will provide notice (email or in-app) before they apply. If you continue using the service after the effective date, the updated Terms apply.

3. Account Creation

To use WorkoutGen, you must create an account by providing a valid email address and secure password. You are responsible for maintaining the confidentiality of your login credentials.

You must be at least 15 years old to create an account. Users under 18 must obtain consent from their parents or legal guardians.

You agree to provide accurate information and keep it up to date. One account per user is permitted.

4. Plans and Pricing

4.1 Free Version

WorkoutGen offers a free version including:

• AI-generated workout programs
• 500+ HD exercise videos
• Progress tracking
• Multi-platform access (iOS, Android, Web)
• Offline mode
• Ad-free in the current offer

4.2 Premium Subscriptions (Workout Plus & WorkoutGen Max)

Premium subscriptions unlock advanced features:

• Real-time workout adaptation based on your feedback
• Personalized intensity based on your profile and feedback
• Smart pattern detection (plateaus, oscillation)
• Continuous optimization to support progression
• 2x points multiplier on all rewards

4.3 Pricing

Applicable pricing:

• Workout Plus pricing is shown at checkout and in the subscription screen.
• WorkoutGen Max pricing is shown at checkout and in the subscription screen.

Subscription plans are listed in USD. Checkout, taxes, and any payment-currency conversion are handled by Lemon Squeezy, our Merchant of Record.

4.4 Subscription Activation

When you subscribe to Workout Plus or WorkoutGen Max, your subscription activates immediately and you are charged. You can cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period.

5. Payment and Billing

Payments are securely processed by Lemon Squeezy, LLC (our Merchant of Record). We accept credit cards (Visa, Mastercard, American Express), PayPal, and other local payment methods depending on your country.

We never store your credit card information on our servers. All transactions are encrypted and secured in compliance with PCI-DSS standards.

Subscriptions automatically renew at the end of each billing period unless you cancel. You can cancel your subscription at any time from your account settings.

Invoices for all your payments are available at any time through the Lemon Squeezy customer portal, accessible from your account settings.

As Merchant of Record, Lemon Squeezy, LLC is the legal seller of your purchase and handles all payment-related matters, including taxes, compliance, and customer support for billing inquiries. By making a purchase, you also agree to Lemon Squeezy's Buyer Terms.

6. Cancellation and Refunds

You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No prorated refund is provided for partially used periods, without prejudice to mandatory legal rights (including applicable consumer withdrawal rights).

For digital services with immediate access, you may be asked at checkout to expressly consent to immediate performance and acknowledge loss of the 14-day withdrawal right where allowed by law (French Consumer Code, Article L221-28).

7. Use of Service

7.1 Acceptable Use

WorkoutGen is for personal use only. You agree to:

• Use the service in compliance with applicable laws
• Not share your account with others
• Not copy, reproduce, or distribute the app's content without authorization
• Not attempt to bypass security measures or access unauthorized features

7.2 Exercise Disclaimer

WorkoutGen is a workout planning and tracking application. It does not provide medical advice. For questions about exercise technique, consult a qualified fitness professional.

• Users are responsible for knowing their own limits
• Start gradually and progress at your own pace
• Adjust intensity according to your comfort level
• Use proper technique on all exercises

You use WorkoutGen at your own risk. Stop exercising if you experience discomfort and adjust the program as needed for your comfort level.

8. Intellectual Property

All content on WorkoutGen (text, images, videos, logos, interface, source code, algorithms) is protected by copyright and belongs to JCODE or its partners.

You are granted a limited, non-exclusive, non-transferable license to use the application for personal purposes. Any other use (commercial, reproduction, modification) is strictly prohibited without prior written authorization.

"WorkoutGen" and its logo are registered trademarks of JCODE.

9. Privacy

We take your privacy seriously. How we collect and use your data is detailed in our Privacy Policy.

10. Limitation of Liability

WorkoutGen is provided "as is" without warranty of any kind. We strive to maintain 24/7 service availability but do not guarantee uninterrupted access.

JCODE shall not be liable for:

• Physical injuries resulting from use of workout programs
• Service interruptions due to circumstances beyond our control (network outage, cyberattack, etc.)
• Data loss due to technical failure
• Indirect or consequential damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE TOTAL AMOUNT PAID BY YOU IN THE PAST 12 MONTHS. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

11. Termination

You can delete your account at any time from the app settings. Deletion is permanent and results in loss of all your data.

We reserve the right to suspend or delete your account in case of:

• Violation of these Terms
• Fraudulent use of the service
• Abusive behavior toward our team or other users
• Non-payment of amounts due

In case of termination for serious breach, no refund is generally provided, without prejudice to mandatory legal rights.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue all or part of the service at any time. We will notify you of major changes when possible.

Prices may be modified at any time. Existing users will be notified at least 30 days in advance and may choose to keep their current rate until the end of their current subscription period.

13. Governing Law and Jurisdiction

These Terms are governed by French law. Mandatory consumer protection rules of your country of residence remain applicable when required by law.

Any dispute relating to these Terms should first be addressed to our support team for an amicable resolution. In the absence of an amicable solution, disputes may be brought before competent courts as provided by applicable law, including mandatory consumer jurisdiction rules.

In accordance with Article L.612-1 of the French Consumer Code, you may also submit any dispute to a consumer mediator free of charge. The European Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr
